Further to our earlier news item regarding the recent Full Court decision in Aristocrat Technologies Australia Pty Ltd v Commissioner of Patents [2025] FCAFC 131, the Commissioner of Patents has today, 14 October 2025, lodged an application for leave to appeal the Full Court’s decision to the High Court of Australia.  Leave to appeal is discretionary – even if leave is granted, the Full Court’s decision reflects the current state of the law in Australia for computer-implemented inventions until any decision from the High Court issues.  We will keep you informed of any developments.
